RETURN & REFUND POLICY

 

1. Right of Withdrawal

In accordance with Book VI of the Belgian Code of Economic Law and applicable European consumer legislation, the consumer has a statutory right of withdrawal of fourteen (14) calendar days starting from the day following the delivery of the product.

Within this period, the consumer has the right to withdraw from the agreement without providing any reason.

To validly exercise the right of withdrawal, the customer must contact BAGATEL in writing within the aforementioned period via [email address], stating:

  • the order number;
  • the relevant items;
  • the date of receipt of the order.

Following notification of the return request, the customer will receive further instructions regarding the return shipment.


2. Conditions for Returns

Returned items shall only be accepted provided that all of the following conditions are cumulatively met:

  • the item is in its original, unused, unwashed and undamaged condition;
  • all original labels, tags and packaging remain fully intact;
  • the item shows no signs of wear, odors, stains, damage or any other depreciation in value;
  • the return shipment is initiated within the statutory withdrawal period.

BAGATEL expressly reserves the right to refuse returns, in whole or in part, where the above conditions are not met.

If a depreciation in value is established that exceeds what is necessary to assess the nature, characteristics and functioning of the product, BAGATEL reserves the right to charge proportional compensation.


3. Exclusion of the Right of Withdrawal

Pursuant to Article VI.53 of the Belgian Code of Economic Law, the right of withdrawal cannot be exercised with regard to:

  • personalized or custom-made goods;
  • sealed goods that are not suitable for return due to health protection or hygiene reasons and whose seal has been broken after delivery;
  • gift cards;
  • items explicitly marked as non-returnable on the webshop.

Sale items may only be returned where expressly permitted by BAGATEL.


4. Return Costs and Liability

Except in the case of incorrect or damaged items delivered by BAGATEL, all costs and risks associated with the return shipment shall be borne entirely by the customer.

The customer remains responsible for ensuring proper and timely return delivery. BAGATEL shall not be held liable for lost, damaged or delayed return shipments.

The use of a trackable shipping method is strongly recommended.


5. Refunds

Upon receipt and inspection of the returned goods, BAGATEL shall proceed, where the return is approved, with reimbursement of the relevant purchase amount using the same payment method as used for the original transaction.

Refunds shall be processed within a maximum period of fourteen (14) calendar days following receipt and approval of the returned goods.

BAGATEL reserves the right to withhold reimbursement until the returned goods have been effectively received or until the customer has supplied proof of return shipment.

Original shipping costs shall only be reimbursed where legally required.


6. Exchanges

As a general principle, BAGATEL does not provide direct exchanges of products.

Should the customer wish to receive a different size, color or variation, a new order must be placed through the webshop.


7. Damaged or Incorrect Goods

Complaints regarding damaged, defective or incorrectly delivered items must be submitted in writing within forty-eight (48) hours following delivery via [email address].

Such notification must include clear photographic evidence of:

  • the received item;
  • the packaging;
  • the alleged damage or discrepancy.

Failing timely notification, BAGATEL reserves the right to declare the complaint inadmissible.
